Statement from Howard K. Stern’s Attorney

A couple of points:

(1) Mr. Stern and his attorneys have been aware of the California Department of Justice investigation for several months. A few months ago, I spoke with Danny Santiago, one of the Department of Justice investigators, who told me that Mr. Stern was not a target of the investigation at that point. He assured me that if Mr. Stern’s status changed, he would let me know. I advised Agent Santiago that Mr. Stern was willing to be interviewed by the Department with no conditions. I never heard back from Agent Santiago.
(2) I am also aware that in recent weeks, Don Clark, an investigator for the law firm of John O’Quinn (which law firm Howard sued for defamation and which case was settled amicably last fall) was in touch with the CA Department of Justice in an effort to have Mr. Stern prosecuted. I have taken efforts in Mr. Stern’s civil cases to have Mr. Clark’s deposition testimony unsealed in its entirety to present to the Department. Mr. Stern and I have also made efforts to have all of the evidence and hundreds of hours of sworn testimony from the civil cases unsealed and released to the public.
(3) Mr. Stern has nothing to hide and very much wants the public and California authorities to have the benefit of reviewing the hundreds of hours of sworn testimony from the key witnesses to the relationship between Mr. Stern and Anna Nicole Smith before rushing to an unsupported judgment against him. I urge Fox News to join in our efforts to present all of the facts to the public.
